South Dakota Abortion Ban, v2.0

As it tried in 2006, South Dakota is trying again to ban abortion within its borders. This time, it's added in exceptions for the life of the mother, rape, or incest. The full text of the initiative can be found here. This would make the doctor performing the abortion a violator of a Class 4 felony, which would entail "...[t]en years imprisonment in the state penitentiary...In addition, a fine of $10,000 may be imposed..." according to the law in South Dakota. Rape and incest abortions are restricted to within the second trimester, 20 weeks to be precise. It also requires that abortions performed for that reason have to have samples collected and must be reported.

This is South Dakota's attempt at trying to get Roe v. Wade overturned. Governor Rounds has been an ardent opponent to abortion and had endorsed Huckabee for President. It's not unexpected for him to be such a strong supporter of this type of legislation. This November, we'll find out if the people of South Dakota are going to put into the law one of the first serious challenges to Roe we've seen in a long time. As an opponent of Roe on a Constitutional basis, I await to see the outcome of their challenge.
